1. REQUIREMENTS
The client should be healthy and must not suffer from an infectious disease. At the beginning of and during of a group tour the guide of the group reserves the right to exclude any participant completely or partially who evidently does not comply with the requirements or disturbs the trip effectively and does not react duly to the dissuasion of the guide. In this case no claim exists for refund of the paid tour price.
Participation is open to everyone who meets the specific requirements, mentioned in the description of the journey and brings the adequate equipment (helmet, clothes, bicycle) with him or rents it after reservation. Your own bicycle has to be in an optimal technical condition. The client is responsible for maintenance, failure and repair of his own bicycle, brought with him. The wearing of a helmet is obligatory for all tours. Basically, every participant cycles at his own risk and is aware of the dangers that can arise when using a bicycle. He is alone responsible for meeting the physical requirements of the cycling journey booked.
Nevertheless, it is possible to travel with the accompanying van, if there is overstraining or sickness and the client has booked a group tour. Although the routes mainly follow fully developed bikeways, the participant should be sufficiently informed of the Thai road traffic regulations. The participation of minors is only possible in the company of an adult and with the signature of a legal guardian.
2. REGISTRATION AND CONFIRMATION
Booking a Chilli Cycling tour commences when you complete our online booking form. It is necessary for you to complete this form, in order to proceed with your booking. Participation in one of our tours is only valid once we have received the booking form. The first named client must be over 18 years of age. A booking is accepted and becomes definite only from the date when the company sends a confirmation. It is at this point that a contract between the company and the client comes into existence. Payment of your deposit, and selecting that you have read these booking conditions, equates to agreeing to the terms of services and stipulations as indicated below. Please read the booking form completely before initiating a deposit and contact us, if you should require further clarifications of any of the conditions following conditions.
3. PAYMENTS
We require a deposit or full payment in order to reserve a place for you on a tour. In the unlikely event that we are unable to operate the tour, the deposit or tour cost will be transferred to another tour at your discretion. The balance of the tour cost must be paid 45 days prior to the departure date. Bookings made less than 45 days before the tour start date will require full payment once a booking is confirmed. The booking is payable withing 3 days after receipt of the invoice. The tour price must be paid in full before participation in a tour. No person(s) will be allowed to join a tour without fully settling their invoice and receiving a confirmation from us.
Without full payment until 14 days before tour commencement the client has no further claim for provision of the journey, but an obligation for payment of cancellation charges. Payment from abroad has to be authorized free of costs for Chilli Cycling. Some last-minute miscellaneous fees can be settled on the day of arrival. (visa fees, additional local hotel bookings…).

4. SERVICES
Our services are being described on our web page. Each Chilli Cycling tour includes different services in terms of included activities, meals and transport. Chilli Cycling reserves the right to change inclusions as listed due to operational or other factors. The shared use of trip inclusions by persons other than guests with full booking confirmation and payment is not allowed and guests found to be in violation of this will face immediate termination of their tour participation without recourse.
5. CHANGE OF SERVICES & PRICES
Chilli Cycling pledges never to increase the tour price except under exceptional circumstances for those that have previously booked the tour. Circumstances of this policy include government action or legislation that directs the company to increase prices, exceptional and unfavorable changes in exchange rates that exceed a 20% fluctuation or currency devaluation. Clients will be notified of any price increase at least 30 days before departure. Changes and differences of single travel services to the contractually agreed content of the travel contract are allowed if they are not substantial and do not affect the complete nature of the booked journey. Such changes as other cycling routes or accommodation can be necessary as a result of weather or for organizational reasons.
6. MINIMUM TURNOUT FOR GROUP TOURS
Basically, the group tours can be implemented only, if the minimum turnout of four adult persons (if not otherwise stipulated in the description of the journey) has been met. Otherwise, we reserve the right to cancel the contract up to 14 days before the agreed departure date or to suggest a substitute journey scheme. In this case, it is also possible for you to rebook the journey without additional charges into an individual tour with the services stipulated on our homepage. The payments or rather the payment difference you have already made will be refunded. Further demands against us cannot be made.
7. BREAKING OF THE JOURNEY
If due to any reason you abandon a journey ahead of time, regardless of his reasons, no refund can be made.
8. CANCELLATION BY CHILLI CYCLING
On the rare occasions when we must cancel a trip, all payments received to date will be 100% refunded.
9. WITHDRAWAL BY TRAVELER
The traveler’s withdrawal will take effect after a written withdrawal declaration has come in at Chilli Cycling. Cancellation charges will be imposed as a percentage of the total tour price, including surcharges as follows.
Cancellation charges per person:
- 90 days before departure: Admin expenses (Bank fees, any costs caused by cancellation)
- 60 to 89 days before departure: Deposit paid
- 45 to 59 days before departure: 50% of tour price
- 15 to 44 days before departure: 70% of tour price
- 0 to 14 days before departure: 100% of tour price
Thailand tours (3 days or less than 3 days)
- 8 days before departure: Admin expenses (Bank fees, any costs caused by cancellation)
- 48 hours to 7 days before departure: 50% of tour price
- Less than 48 hours before departure: 100% of tour price
- No show: 100% of tour price
10. CANCELLATION DUE TO EXTRAORDINARY CIRCUMSTANCES
If the journey is substantially complicated, endangered, or compromised due to circumstances we are not responsible for – war, strike, riots, epidemics, mandatory regulations, and the like – both parties can withdraw from the contract or respectively cancel it. This is also valid if journeys cannot be commenced or have to be canceled due to external circumstances (extreme weather, returning because of an injured participant or the tour guide, etc.). Additional costs for a potential return journey are at your expense. Of course, we will refund the price paid for the tour less a service charge. Exceptions to this policy cannot be made for any reason, including weather or personal emergencies. Chilli Cycling is not responsible for expenses incurred in preparation for any canceled trips, such as airline tickets. We regret that we cannot be held responsible for incidental/consequential costs or expenses you may incur as a result of any changes or cancellations. No compensation is payable for minor changes. Any damages/injuries incurred that are attributable to your own actions, acts of some other party unconnected with the contract services, or where the damage/injury results from events/circumstances which are outside our control and could not be reasonably foreseen. For damages where Chilli Cycling is responsible, our liability is strictly limited to twice the total price of the tour. In booking a tour with Chilli Cycling you, the client, are agreeing to these terms and you accept this limit on our liability.
11. CHANGE OF RESERVATION
There is no legal right to make changes with respect to the date of the journey and the destination after concluding the contract. If changes of reservation are possible and Chilli Cycling agrees to them, a single service charge of THB 1,500 per person is due. You can transfer your booking to another person up to 14 days before departure. You have to alert us to this change in writing. The substitute person has to fulfill the terms and further prerequisites connected with the participation of the journey, whereas both (substitute person and forwarding person) are liable jointly and severally to pay for the balanced price and arisen additional costs. Such additional costs can be, for example, no more possible double room occupancy.
12. TRAVEL DOCUMENTS
You must be in possession of a valid passport and all the visas and permits required for your tour. This includes any medical certificates that are required. The client accepts full responsibility for obtaining any and all such documentation. Every client is encouraged to contact the consulate or embassy for the countries they are traveling in respectively to receive the latest and most current information about their immigration and transit policies. Chilli Cycling does not accept responsibility if your documentation is not in order. Information provided by the company about these matters and other related items (clothing, baggage, climate, etc.) is given in good faith but without responsibility on the part of the company.
13. TRAVEL INSURANCE
Insurance is mandatory for all clients whilst on a tour organized by Chilli Cycling. Clients are wholly responsible for arranging their own insurance and that they are in possession of private travel insurance with protection for the full duration of the tour.
This insurance must include adequate coverage for any personal accident, medical expenses, injury, death, and repatriation. Insurance should also provide coverage for cancellations or curtailment of the holiday. Clients should also ensure that there are no exclusion clauses limiting protection for any dangerous or unusual activities that might be included in their tour. If you join the tour without adequate insurance you may be disallowed from continuing on the tour without the right of refund. Your tour leader will ask for copies of your insurance before allowing you to join the tour. We also strongly advise that clients have full personal travel insurance that covers the refund of monies paid in case either party cancels the tour for any reason.
14. FLIGHT OR DELAYS
We will not accept any liability for any delay in your flights, whether the cancellation or delay is caused by the weather, airline rescheduling, industrial action, or mechanical failure. We will give no refunds or compensation for lost time and services from the itinerary.
15. COMPLAINTS
Should one of our tours have a deficiency despite all efforts, you should make your complaint to the tour guide or to Chilli Cycling immediately. You are obliged to contribute to avoiding potential damage or to limit it if there are any deficiencies. Failure to do so will result in limiting a client’s ability to claim compensation. We reserve the right to remedy such problems by providing a similar or more valuable substitute. Claims because of non-fulfillment or not contractual fulfillment have to be asserted within one month after the conclusion of the journey.
16. LIABILITIES
The traveler takes part in the trip at his own risk. Chilli Cycling is not liable for personal injury or property damage as a result of (but not limited to): physical exertion for which a guest is not prepared, forces of nature, travel by plane, train, car, boat, or other means of transport, or by bike, horse, foot or any other form of active or adventure travel, consumption of alcoholic beverages, civil unrest, terrorism, equipment failure, high altitude, lack of or limited access to medical care in remote locations and the adequacy of medical care once provided.
Chilli Cycling is also not liable for: Expenses (meals, transport, or hotel costs) that are not included in the tour price but may be necessary to get to or from a travel start or endpoint. Any liability for damage to luggage is excluded if this damage was unavoidable during carrying or lifting due to the age or condition of the piece of luggage. Should a piece of luggage be lost or damaged we are liable only, if the loss was caused by one of our employees deliberately or through gross negligence and if this loss was reported immediately after notifying us. For losses not covered by this clause, we recommend baggage insurance. This limitation of liability is also valid for carriage by external operators.
Chilli Cycling reserves the right to make route and hotel modifications as necessary to improve the trip quality or to accommodate the comfort and well-being of guests. Guests grant Chilli Cycling express permission to take photographs or make film records of its trips for promotional and commercial use, as well as approve such use by third parties with whom Chilli Cycling may engage in joint marketing, without financial remuneration.
Chilli Cycling reserves the right to amend typos and misprints in pricing and other trip information. We reserve the right to decline to accept or to retain any person as a member of a tour or to require a participant to withdraw from the journey at their expense when such an action is determined by staff to be in the best interest of the participant’s health and safety, and that of the group in general. No refund will be made for the unused portion of any tour. Chilli Cycling does not accept liability incurred by the purchase of a non-refundable airline ticket.
17. LIABILITY FOR RENTED BIKES & EQUIPMENT
Any loss or damage to bikes, and other tour equipment, resulting from improper use and/or failure to follow instructions with regards to safety and operation, will be charged to the customer to the equivalent value of the repair or replacement costs.
18. HELMETS
It is required that a bicycle helmet be worn by all cyclists. Failure to wear a helmet will result in the customer not being allowed to cycle as a part of the tour program.
